Terms of Use
1. Acceptance
By using our apps, games or website (the “Services”), you agree to these Terms and our Privacy Policy. These Terms are also the end-user license agreement (EULA) for our apps.
2. Who we are and what we offer
The Services are provided by Aster Hills LLC (“Aster Hills”, “we”, “us”). We make wellness, productivity and lifestyle apps for iPhone and Android, and interactive story games. We do not provide medical care.
3. Eligibility
You must be at least 13 (or 16 in the EEA/UK). If you are under the age of majority where you live, you need permission from a parent or guardian.
4. Subscriptions and billing
Some features require an auto-renewing subscription or an in-app purchase. Payments, renewals and refunds are handled by Apple (App Store) or Google (Google Play). A subscription renews automatically unless you cancel at least 24 hours before the end of the current period. If an app offers a free trial, it turns into a paid subscription unless you cancel before it ends, and any unused part of a trial ends when you subscribe. You can manage or cancel subscriptions in your Apple ID settings (iOS: Settings → your name → Subscriptions) or in Google Play (Payments & subscriptions). Prices may change; we’ll honor your current term and tell you about changes where required.
5. License
We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the apps on devices you own or control, for your own non-commercial purposes, subject to these Terms and the usage rules of the App Store or Google Play.
6. Your content
You keep all rights to your content (for example habits, meals, prompts, notes and images). You give us a limited license to process it only to provide and improve the Services. You’re responsible for the legality and accuracy of your content.
7. AI features
- Some features use OpenAI, a third-party AI provider, to create text, plans, meditations, affirmations, food and label recognition, and redesigned room images. We only send content to them after you agree, as described in our Privacy Policy.
- AI output can be inaccurate, incomplete or unexpected. It is general information, not medical, nutritional, psychological, design or other professional advice. Don’t rely on it in emergencies or for clinical decisions, and double-check anything important.
- Only submit content you have the right to use. Don’t submit other people’s personal information, or photos of other people, without their permission.
- You may use the AI output you create for your own personal purposes. Because of how AI works, similar output may be created for other people.
- We may limit how often AI features can be used, to keep them fair and to prevent abuse.
8. Acceptable use
You agree not to: (a) reverse engineer the apps; (b) bypass security or usage limits; (c) misuse AI features, including to create illegal, harmful, hateful or sexual content involving minors; (d) upload malware; (e) use the Services to build a competing service; or (f) break any law or anyone else’s rights.
9. Games
Our interactive story games may offer optional in-app purchases or subscriptions, billed by Apple or Google. Any virtual currency or items have no real-world value, can’t be exchanged for cash, and are licensed to you, not sold.
10. Advertising and analytics
Some apps show ads and use advertising and analytics SDKs (Meta, Google AdMob, Amplitude), subject to your consent where required. If you decline tracking, we limit them to non-personalized ads and aggregated measurement.
11. Third-party services
We use third-party providers to operate the Services, including OpenAI, Google Firebase, Apple, Google Play and Netlify. They process data under our instructions. Their own terms apply to their services, and we aren’t responsible for them.
12. App Store and Google Play
- These Terms are between you and Aster Hills only, not Apple or Google. We, not Apple or Google, are responsible for the apps and their content.
- Apple and Google have no obligation to provide maintenance or support for the apps.
- If an app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price for that app, if any. To the maximum extent allowed by law, Apple has no other warranty obligation for the apps.
- We, not Apple, are responsible for any claims relating to the apps, including product liability claims, claims that an app fails to meet a legal or regulatory requirement, consumer protection claims, and intellectual property claims.
- You confirm that you are not located in a country subject to a US Government embargo or listed as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple may enforce them against you.
13. Ending your use
You can stop using the Services at any time. We may suspend or end access if you break these Terms or to protect the Services. When that happens, your license ends.
14. Disclaimers and limitation of liability
The Services are provided “as is”. To the fullest extent permitted by law, we disclaim warranties and are not liable for indirect or consequential damages. Our total liability is limited to the amount you paid us (if any) in the 12 months before the claim. Consumer rights that cannot be limited by law are not affected.
15. Indemnity
You agree to indemnify us against claims arising from your misuse of the Services or breach of these Terms.
16. Governing law
These Terms are governed by the laws of Portugal (without regard to conflict-of-law rules). The courts of Lisbon have jurisdiction, unless mandatory consumer laws say otherwise.
17. Changes
We may update these Terms. We’ll announce material changes in the apps or on our website. If you keep using the Services after a change, you accept the updated Terms.
